The darker side of human rights

The Declaration, which was adopted by the UN General Assembly 60 years ago on this day in 1948, states that everyone has the right to life, liberty and security and that all – regardless of race, gender, colour, sex, language, religion or political opinion – are equal before the law.

Lawyer K B N Lam moved an application in a session's court expressing his willingness to defend arrested Pakistani terrorist Mohammad Ajmal Kasab in a court.

Good thing that this does not apply to the terrorists, A Mumbai-based lawyer last week turned down the court’s request to hold Ajmal’s brief. To this, eminent jurist Ram Jethmalani, who had held the brief for the late prime minister Indira Gandhi’s assassins, said that a lawyer has no right to do so. In 1984, Ram Jethmalani, a Delhi-based lawyer, defended Satwant Singh and Kehar Singh, the alleged assassins of Indira Gandhi, a former prime minister.

The members of the UN Security Council underlined the need to bring perpetrators, organizers, financiers and sponsors of these reprehensible acts of terrorism to justice and urged all States, in accordance with their obligations under international law and relevant Security Council resolutions, to cooperate actively with the Indian authorities in this regard.

Chief Justice says Kasab, the terrorist under custody should get a lawyer to defend himself. He says, I don t think he will go undefended. Even for helping the court for a proper trial assistance of a lawyer is required.What is the role he has played will come to light if there is a fair trial. Somebody will have to defend. It shall not be one way traffic.

For anyone who comes to defend a terrorist should be considered as a promoter of terrorism, and all laws pretaining to terrorists should be applied for any one who comes to defend terrorists as the terrorist, has given the testimony of the event that has taken place and the role played.
